Doesn't matter 101; you can demand your shares be placed in a cash (or custodial) account where they cannot be hypothecated.

Interesting. Santelli basically just mentioned this as a possible reason we are seeing the financials up today....he asked Grasso about it and with a smirk at the end said "very interesting..."

You will see the XLF at 14 if that turns out to be real. Consider the firms where the government has an effective majority interest. You pull all those short shares supply and the forced buy-ins will be insane. ---------- "The monetary base in ALL modern monetary systems is the sum of unencumbered assets against which one is both WILLING AND ABLE to borrow." - Me

i see the runnup in the weak stocks as proof the gov't is too chicken **** to do anything about AIG. BK solves this bonus problem. that option is not on the table, despite "all options" being discussed. I have to assume they could BK and fire everyone involved, but what the hell do I know. ---------- It'll get worse. Just wait.

KD, if the rumor is true then all these financials will be shorted? Sorry for a dumb question but just trying to understand.

Did the ban last fall force you to buy back in if you were already short before the order?

Let the panic begin... bb-bbb-bbooyah. Behind every Chuck Norris kick is another financial share. LOL. ---------- It sounds antiquated, merchantilistic - until you figured out that I was hoarding for war.

Quote:KD, if the rumor is true then all these financials will be shorted? Sorry for a dumb question but just trying to understand. They all are heavily shorted. If the gov demands its shares, those that have borrowed shares to short will have to cover, causing prices to go up.

April XLF $11 calls are dirt cheap too. Trading at $0.17. I figure I'll buy a few just in case.

keewaydin: almost anyone who is short shares is borrowing currently uncertificated / unhypothecated shares that are held in cash accounts. if the gov't certificates or forces them into a nonlendable account, the available supply of shares to short would quickly shrink. the question then becomes how many shares are short that would have to be covered. I have no idea, but I think FRE and FMN the gov't bought preferred shares each time, which aren't traded. private issue. aig on the other hand could be big time affected if gov't either demands shares be segregated or forces BK to stop these ridiculous payments. if gov't is smart, it is making aig sell fresh shares into the rally...but we know that isn't happening. ---------- It'll get worse. Just wait.

Color me confused. I thought with "naked shorting" an "infinite" number of shares were available for shorting. If the .gov removes it's shares, are there not still an infinite number for naked shorting?

"There is absolutely no reason for the government to permit the shares it holds to be borrowed for the purpose of short sales." Don't you get paid to lend shares? If share price rises doesn't that mean you make interest gains and capital gains?

Karl, I don't understand why you're in favor of this (even demanding Obama's impeachment if he doesn't do it! :-). All it does is screw people who took out legitimate short positions. It's no different from Bernanke and Paulson screwing the shorts through their rate cuts back when CFC and BAC hit, which you opposed strenuously. Are you just talking your book since you bought some C "lottos"? ---------- I have even intermittenter access than I did over the summer. No idea when I can check in.
